A NY DWI Lawyer would agree that being charged with a DUI or DWI in New York is a very unsettling experience. Suddenly you are faced with unfamiliar legal terminology, police bookings, court dates and very real penalties. In New York, a first offense DWI charge is considered a misdemeanor offense. New York Vehicle and Traffic Law 1192 provides that a DWI is committed when someone operates a motor vehicle with a blood alcohol content (BAC) of .08% or greater. This area of law is complex. It is important to speak with a dedicated New York DWI Attorney as soon as possible after you have been charged. You could be facing penalties that include jail time, fines and loss of your driver’s license.

It is important to understand the difference between several common DWI charges:

DWI: A DWI involves operating a motor vehicle with a blood alcohol level of .08% or above.

Aggravated DWI: An Aggravated DWI involves operating a motor vehicle with a blood alcohol level of .18% or above.

DWAI: A DWAI involves operating a motor vehicle with a blood alcohol level of .05% to .07%, or otherwise ability impaired by a substance other than alcohol.

Penalties:

DWI Penalties: A first time offense is punishable by up to one year in jail and/or fines, and a 6-month license suspension, and 3 years probation. A second offense within a ten-year period qualified as a Felony DWI and enhanced sanctions. You could be facing a one year in jail, fines, a one year license revocation, and 3 years probation.

DWAI Penalties: A DWAI charge is considered a traffic infraction, and it is not reflected on your permanent record. Penalties however include 15 days in jail, a fine, and a 90 day license suspension. If this is your second offense, you are looking at 90 days in jail, a fine, and a 6 months suspension of your license.
